PDPA Notice

The Personal Data Protection Act 2010 (the “PDPA Act”), which regulates the processing of personal data in commercial transactions applies to GE and its group of companies, direct and indirect subsidiaries, associated, related and affiliated companies as well as their subsidiaries, associated, related and affiliated companies, both local and international, whether present or future (referred herein as “GE Group”, “our”, “us” or “we”).

For the purpose of this PDPA Notice (“Notice”), the terms “personal data” and “processing” shall have the same meaning as prescribed in the PDPA Act.

1. This Notice serves to inform you that your personal data is being processed by us or on our behalf and you hereby give your consent to the processing of your personal data.
2. Your personal data includes your name, NRIC number, passport number, photograph, place of birth, date of birth, marital status, residential address, e-mail address, contact numbers and details, age, race, gender, nationality, religion, medical information, particulars of educational qualification and academic achievements, employment history and achievements, proficiency in languages and personal skills, Employee Provident Fund (“EPF”) details, Social Security Organization (Malaysia) (“SOCSO”) details, Income Tax details, bank account details and all other related personal data we collect from you on any occasion (“Personal Data”).
3. Your personal data will be collected and further processed for the following purposes:
   
   1. Inquiries to verify the information provided by you in your application;
   2. Consideration, evaluation and selection of your application including reference verification and background screening;
   3. Security and access within the Company;
   4. Contact purposes;
   5. Compliance with laws and regulations including requirements of any government, quasi-government, regulatory authorities, law enforcement agency requirement, court orders, legal processes or is required by law;
   6. Administration and management of employment matters i.e. salary and benefits;
   7. Career progression and personal development;
   8. Long Term Incentive Plan;
   9. Analytics as required by governmental bodies and/or other agencies;
   10. Employment and industrial relations disputes, which includes but are not limited to litigation and/or other relevant legal affairs;
   11. Corporate exercises undertaken by GE Group;
   12. Performance Management;
   13. Application of work permits and immigration requirements (if applicable);
   14. loans, insurance, medical purposes;
   15. research, salary surveys and audit;
4. Your personal data will be collected from your job application submission via the “Careers” tab in our website together with all the information that was submitted by you through any online and/or physical submission, background verifications and references (“Application Submission”).
5. You may, by providing us with a notice in writing:
   
   1. Limit the processing of your personal data or request to cease or not begin processing your personal data for purposes of direct marketing; and/or
   2. Withdraw your consent previously given to us (in full or partial) to the processing of your personal data, subject to any applicable legal restrictions and a reasonable period for such notice/request to be affected.
6. If you limit the processing or withdraw your consent to any or all for the use of your personal data, it may result in the following:
   
   1. Us being unable or continue to administer any arrangement or contractual relationship between you and GE;
   2. Us being unable or continue to perform any of our contractual obligations to you (if any);
   3. Us being unable to process your personal data for any of the Purposes; and/or
   4. The termination of any arrangements, agreements, contracts between you and GE, without any liability on our part (“the Implications”).

8. Subject to provisions of the Act:
   
   1. You may, upon payment of a prescribed fee, make a data access request in writing to us; and
   2. Based on the situation, and if applicable, we may refuse to comply with the data access request or a data correction request. In this instance, we shall by notice in writing, inform you of our refusal and the reasons of our refusal.
9. Any of the GE Group entity who collected your personal data may disclose your personal data to companies within GE Group, third party organizations who are providing administration and/or other services to GE Group, business partners, entities who are involved in any corporate exercises undertaken by GE Group, governmental departments and/or agencies, regulatory and/or statutory bodies and any such third party requested or authorized by you within or outside Malaysia, for and in respect of the Purposes.
10. We may require your assistance to obtain relevant consent of third parties whose personal data is made available by you to us and you hereby agree to use your best efforts to do so.
11. In the event that personal data of any third party is provided by you to us, you shall ensure that such third party has read this PDPA Notice and has unequivocally consented to us collecting his/her personal data for any of the Purposes prior to the disclosure of his/her personal data to us.
12. Where the third party is disclosing any of your personal data to us, you agree that you have authorised the disclosure of your personal data to us and consented to the processing of your personal data by us in accordance with this PDPA Notice.
13. It is obligatory that you supply us your Personal Data as mentioned in Paragraph 2 (collectively, “compulsory personal data”). If you fail to supply us with the compulsory personal data, it may result in any of the Implications (as specified in paragraph 6 above).
14. We may transfer your personal data to a place outside of Malaysia and you hereby give your unequivocal consent to the transfer.
15. You are responsible to ensure that the information you disclose is accurate, complete, not misleading and is up to date.
16. In the event of any inconsistencies between the English version and the Bahasa Malaysia version of this PDPA Notice, the English version shall prevail over the Bahasa Malaysia version.
17. Please note that GE may amend this PDPA Notice from time to time without prior notice and will publish the amended or revised PDPA Notice on our website. Any such amendments will be effective upon such publication.
